The Legal Framework for Surrogacy in Canada: What Every Family Needs to Know

One of the most common questions I hear from families new to surrogacy is: "Is it even legal in Canada?"

The answer is yes — and in many ways, Canada has one of the most clearly regulated and family-friendly surrogacy frameworks in the world. But there are important nuances to understand before you begin.

The Assisted Human Reproduction Act (AHRA)

Canada's surrogacy landscape is governed primarily by the Assisted Human Reproduction Act, which came into force in 2004. The AHRA establishes several key principles:

Altruistic surrogacy is legal. A surrogate may carry a baby for intended parents without breaking any law, provided she is not being paid beyond reasonable expense reimbursements.

Commercial surrogacy is prohibited. The AHRA makes it illegal to pay a surrogate a fee for her services, pay an intermediary to find a surrogate, or advertise to pay for surrogacy services. Violations carry serious criminal penalties.

Reasonable reimbursements are permitted. Surrogates can be reimbursed for documented expenses directly related to the surrogacy — including medical costs not covered by provincial insurance, travel, childcare, lost income during medical appointments, and maternity clothing, among others.

Provincial Variation

Here's where things get interesting — and where having an experienced agency and lawyer matters enormously.

While the AHRA operates at the federal level, family law — including parentage — is a provincial matter. This means the process for establishing legal parentage of a surrogacy-born child varies by province.

Pre-birth orders — court orders issued before the baby is born that establish the intended parents as the legal parents — are available in most provinces, including British Columbia, Alberta, Ontario, and Quebec (with nuances). These orders are transformative: by the time your baby is born, you are already legally their parents.

Post-birth orders are still the process in some jurisdictions, meaning intended parents may need to go through an adoption-like process after birth. This is less common as provinces modernize their legislation, but it's still relevant in some situations.

Your reproductive lawyer will advise you on the specific process in your province and the province where your surrogate lives, if different.

The Surrogacy Agreement

Before any medical procedures begin, intended parents and their surrogate must sign a comprehensive surrogacy agreement. This document covers:

  • The rights and responsibilities of all parties
  • The surrogate's agreement to transfer the baby to the intended parents
  • Medical decision-making protocols
  • Compensation and reimbursement terms
  • What happens in various scenarios (multiple births, pregnancy complications, selective reduction, etc.)

Both parties must have independent legal counsel. A surrogate cannot sign an agreement prepared by the same lawyer representing the intended parents.

The agreement is drafted before matching, or very soon after — and it must be in place before the embryo transfer.
