Surrogacy in British Columbia: Vancouver Families, Law and Costs

How surrogacy works in BC: the Family Law Act, parentage, costs, IVF funding, LGBTQ+ families in Vancouver, and finding a surrogate or egg donor.

If you are in Vancouver, Victoria, Kelowna or anywhere in British Columbia, you are not limited to working with someone down the street. Many BC families work with a surrogate in another province, or find one here. We support families across Canada, and here is what to know about BC.

This is general information, last checked October 2026. It is not legal advice.

How the law works in BC

Surrogacy is altruistic across Canada under the federal Assisted Human Reproduction Act. A surrogate cannot be paid a fee, but she can be reimbursed for documented expenses.

Parentage in BC is set out in Part 3 of the Family Law Act. In general, BC uses a written surrogacy agreement made before conception and a process for intended parents to be declared the legal parents after the birth. The details, including what is needed if the surrogate lives in another province, are for your BC reproductive lawyer to confirm.

Costs

A complete journey in Canada typically runs $80,000 to $120,000 CAD. CSO agency programs start from $1,500 (Independent Journey), $9,500 (Foundation), $19,500 (Guided Journey) and $29,500 (Priority Match), plus HST, paid in three equal stages. See our cost guide and try the surrogacy cost calculator.

If your surrogate lives in another province, add travel for key appointments and the birth.

IVF funding

British Columbia announced public funding for one IVF cycle, with medications, starting in April 2025. Eligibility rules and limits can change, so check the BC government's current program and ask your clinic.

LGBTQ+ families

Canadian law recognizes same-sex couples, single parents and families of many shapes. Gay couples in Vancouver and across BC will typically need an egg donor and a surrogate. We can plan both together. See our guide for LGBTQ+ families.

Egg donation for BC families

Egg donation in Canada is altruistic, so donors are reimbursed for documented expenses and not paid. Our sister company Little Miracles matches intended parents with screened donors across the country. Read egg donation in Canada and egg donation costs.

Finding a surrogate

If you want to become a surrogate in BC

You must be at least 21, and clinics generally prefer a prior healthy pregnancy and birth. Start with our self-check.
